Pay transparency in Spain

What the EU Pay Transparency Directive means for employers in Spain, based on its national transposition — status, thresholds, the joint-assessment trigger, and where to file.

Spain has not transposed the Directive (deadline missed). A prior consultation on a transposition Royal Decree closed 8 May 2026 with no draft text yet. Existing rules (registro retributivo under RD 902/2020, equality-plan audits, a 25% justification threshold) predate and do not constitute transposition.

Spain has a transposition bill in progress but has not yet enacted it. The figures below reflect the directive's defaults and the draft as it stands, and may change before the law is final.

Employers with 250+ employees come into scope from 2025. A mean pay gap of 5% or more in a role category triggers a joint pay assessment with worker representatives.

The pay-gap figures must be published, not just filed with the authority. Either way, the underlying work is the same: establish work of equal value through gender-neutral job evaluation, produce the statutory pay-gap report in the national format, and run a joint assessment where the gap is too wide.
